Privacy Policy

Our Commitment To Privacy
Your privacy is important to us. This Privacy Policy explains how MktCo LLC, doing business as Niceboard ("Niceboard", "we", "us", or "our"), collects, uses, discloses, and protects personal information when you visit niceboard.co, create or manage a Niceboard account, use our job board software and related services, contact us, interact with our marketing or support channels, or otherwise use the services we provide (collectively, the "Services").
Personal information means information that identifies, relates to, describes, can reasonably be associated with, or could reasonably be linked to an identifiable person or household. To make this notice easy to find, we make it available on our website and in places where personal information may be requested.
Scope and Roles
Niceboard provides software that allows customers to create and operate job boards, career centers, and related hiring or marketplace experiences. When a Niceboard customer uses the Services to collect, store, or process information from job seekers, applicants, employers, recruiters, purchasers, subscribers, or other end users on that customer's job board, the customer is generally responsible for deciding what personal information is collected and how it is used. In that context, Niceboard generally acts as a service provider or processor to the customer, subject to our customer agreements and applicable law.
If you submit personal information directly to a job board powered by Niceboard, the privacy policy and practices of that job board operator may also apply. Privacy requests about information controlled by one of our customers should usually be directed to that customer. If we receive a request about customer-controlled information, we may forward the request to the relevant customer or assist the customer in responding.
This Privacy Policy also applies to personal information that Niceboard processes for its own business purposes, including account administration, billing, support, sales, product analytics, security, fraud prevention, incident remediation, legal compliance, and operation of our website and Services.
The Information We Collect
The information we collect depends on how you use the Services and which features you or a Niceboard customer enable. We may collect the following categories of information:
Account and contact information. This may include your name, email address, password or authentication credentials, phone number, company name, job title, website URL, business address, billing address, tax or business information, account role, team membership, account preferences, and communications preferences.
Job board and customer content. Customers and their users may provide job board names, logos, domains, branding, settings, job posts, employer profiles, recruiter accounts, pricing plans, subscription settings, page content, translations, custom fields, analytics settings, integration settings, and other information uploaded to or configured in the Services.
Employer, applicant, and job seeker information. Depending on how a customer configures its job board, the Services may process employer, recruiter, applicant, and job seeker information such as names, email addresses, phone numbers, addresses, resumes, cover letters, work history, education history, LinkedIn or website URLs, profile photos, answers to screening or custom questions, job searches, saved jobs, applications, application status, tags, notes, payment or subscription status, and other information submitted through a job board.
Payment and transaction information. We may collect and process information related to subscriptions, invoices, payment methods, billing status, taxes, refunds, disputes, chargebacks, connected Stripe accounts, Stripe customer or account identifiers, Stripe Connect activity, job purchases, add-ons, and other transactions. Payment card details are generally collected and processed by Stripe or other payment processors, not stored directly by Niceboard.
Usage, device, and log information. We may collect IP address, browser type, device type, operating system, pages viewed, referring pages, approximate location derived from IP address, timestamps, session activity, searches, clicks, job views, application events, exports, imports, API activity, admin actions, authentication events, error logs, performance logs, and other technical information about how the Services are accessed and used.
Communications and support information. We collect information you provide when you contact us, book a call, request support, respond to surveys, interact with sales or marketing communications, report a problem, or communicate with us by email, SMS, chat, form, or similar channels.
Integration and third-party information. If you connect or use third-party services with Niceboard, we may receive information from or share information with those services as needed to provide the integration. This may include Stripe, Google Analytics, reCAPTCHA, single sign-on providers, email providers, SMS providers, hosting providers, analytics providers, data import sources, API tools, and other customer-selected integrations.
Sensitive information. Certain information processed through the Services may be considered sensitive under some laws, such as account login credentials, payment-related information, tax identifiers, precise content of communications, or information voluntarily included in resumes, applications, custom fields, or support requests. We use sensitive information only as reasonably necessary to provide, secure, administer, improve, or protect the Services, to comply with law, or as otherwise permitted by applicable law.
We collect information directly from you, from our customers and their authorized users, from job seekers, employers, recruiters, and other end users who interact with job boards powered by Niceboard, from connected integrations and service providers, and automatically through cookies, logs, analytics tools, and similar technologies.
How We Use Your Information
We use personal information for the following purposes:
Providing and administering the Services. We use information to create and manage accounts, authenticate users, operate job boards, publish and manage job posts, process applications, provide dashboards and reports, send job alerts or service notifications, support customer settings, make integrations work, provide APIs, and otherwise deliver the Services.
Payments and billing. We use information to create subscriptions, process payments, collect fees, issue invoices, calculate taxes, manage Stripe Connect and connected payment functionality, process refunds, reverse or retry transactions, respond to failed payments, disputes, chargebacks, duplicate charges, or billing errors, and comply with payment processor, card network, tax, accounting, and legal requirements.
Support and communications. We use information to respond to requests, provide support, send administrative notices, send security alerts, notify you about changes to the Services, communicate about your account, and provide information you request.
Product improvement and analytics. We use information to understand how the Services are used, troubleshoot issues, improve features, develop new features, monitor performance, measure marketing effectiveness, and create aggregated or de-identified data. When we use aggregated or de-identified data, we take reasonable steps so it is not used to identify you.
Security, abuse prevention, and platform integrity. We use information to protect accounts, prevent fraud, detect abuse, investigate suspicious activity, enforce our Terms of Service, protect job seekers, employers, customers, payment processors, and the public, maintain operational stability, and preserve records related to security, payment, support, or compliance matters.
Incident remediation. We may use information, logs, transaction records, job post records, application records, and related data to investigate and remediate bugs, failed postings, failed transactions, billing errors, duplicate charges, data inconsistencies, integration failures, outages, disputes, or other platform issues. Remediation may include refunds, reversals, reposting or correcting content, disabling affected functionality, preserving records, or taking other actions described in our Terms of Service.
Marketing and customer identification. We may use account and business information to send marketing communications, identify customers in customer lists, showcase pages, sales materials, presentations, and other marketing materials, and manage opt-out requests, consistent with our Terms of Service and applicable law. You may opt out of marketing emails by using the unsubscribe link in those emails or contacting us. We may still send transactional, security, legal, and service-related messages.
Legal compliance. We use information to comply with laws, regulations, subpoenas, court orders, processor rules, tax obligations, accounting obligations, and other legal or regulatory requirements, and to establish, exercise, or defend legal claims.
Legal Bases for EEA, UK, and Swiss Users
If privacy laws in the European Economic Area, United Kingdom, or Switzerland apply to our processing of your personal information, we rely on one or more legal bases depending on the context. These may include performance of a contract, such as providing the Services, administering accounts, and processing billing; legitimate interests, such as securing and improving the Services, preventing abuse, supporting customers, conducting business-to-business marketing, and protecting our legal rights; consent, such as for certain cookies, marketing messages, SMS messages, or optional integrations where consent is required; and legal obligations, such as tax, accounting, payment, security, and compliance requirements.
When Niceboard processes personal information on behalf of a customer as a processor or service provider, the customer is generally responsible for identifying the appropriate legal basis for its own collection and use of that information.
How We Share Information
We do not sell personal information for money, and we do not intentionally disclose customer-controlled personal information to third parties for their own marketing, advertising, or independent business purposes. Personal information may be made available to others only in the limited circumstances described below, such as when providers process data on our behalf, when a customer directs an integration or disclosure, when the Services require information to flow between job board participants, or when disclosure is legally or operationally necessary.
With service providers, vendors, and subprocessors. We use companies and professional advisors to help us provide, secure, host, support, analyze, bill for, and improve the Services, and, where applicable, market Niceboard. We do not provide customer-controlled personal information to these parties for their own use. Instead, personal information may flow through, be stored by, or be accessed by these providers only as needed to perform services for us, comply with law, or protect the Services. When we process customer-controlled information as a processor or service provider, some of these parties may act as our subprocessors. These may include hosting, infrastructure, and database providers, payment processors, email and SMS providers, analytics and tracking providers, customer support tools, security tools, logging tools, and legal, accounting, or other professional advisors.
With customers and their authorized users. Information submitted to or generated through a customer job board may be available to that customer and its authorized administrators, team members, employers, recruiters, or other users according to the customer's settings and instructions.
With employers, recruiters, applicants, job seekers, and other job board participants. The Services are designed to help customers operate job boards. For example, applicant information may be shared with the employer or recruiter associated with a job, job seeker profile information may be displayed if a customer enables public or searchable profiles, and employer or job information may be displayed to job seekers.
With payment processors and transaction participants. Payment-related information may be processed by or made available to Stripe and other payment processors, connected accounts, card networks, banks, tax providers, fraud prevention providers, and transaction participants only as needed to process payments, refunds, disputes, chargebacks, payouts, billing errors, subscription fees, platform fees, and related payment operations.
With customer-selected integrations. If a customer or user enables an integration, uses an API, adds tracking code, connects single sign-on, enables reCAPTCHA, imports data, or otherwise directs us to connect the Services with a third party, information may be sent to, received from, or accessed by that third party as needed to provide the integration.
For legal, safety, security, and platform integrity reasons. We may disclose information if we believe it is necessary or appropriate to comply with law, respond to legal process, enforce our Terms of Service, protect our rights or property, prevent fraud or abuse, protect customers, job seekers, employers, payment processors, or the public, investigate security or operational issues, or preserve and defend legal claims.
In business transfers. We may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction.
With consent or at your direction. We may share information when you consent to or direct the sharing.
Cookies, Analytics, and Tracking Technologies
We use cookies, pixels, scripts, local storage, log files, and similar technologies to operate the Services, remember preferences, authenticate users, secure accounts, measure usage, analyze performance, improve the Services, and understand the effectiveness of our marketing.
We may use analytics and tracking tools such as Google Analytics, Simple Analytics, LinkedIn Insight Tag, Microsoft Advertising, X/Twitter advertising tools, Capterra tracking, Rewardful, Hotjar, reCAPTCHA, and similar technologies where enabled. These tools may collect information such as IP address, device identifiers, pages viewed, referring pages, browser information, interactions, and approximate location. Some analytics or advertising technologies may be considered a "sale", "sharing", or "targeted advertising" under certain privacy laws, even when no money is exchanged.
Customers may also add their own analytics, advertising, tracking, or custom scripts to job boards they operate through Niceboard. Those customer-controlled technologies are subject to the customer's privacy practices.
You can control cookies through your browser settings and, where available, through third-party opt-out tools. Blocking cookies may affect the functionality of the Services. Some browsers send "Do Not Track" signals, but there is no uniform industry standard for responding to those signals. Where legally required, you may contact us to exercise opt-out rights related to sale, sharing, targeted advertising, or similar activities.
SMS Communications and Mobile Information
If you provide your mobile phone number and opt in to receive SMS messages, you consent to receive text messages from Niceboard related to your account and use of the Services, including one-time passcodes, verification messages, security messages, and important service-related notifications. Message and data rates may apply. Message frequency may vary.
You may opt out of SMS messages at any time by replying STOP. For assistance, reply HELP or contact us at [email protected]. Carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Text messaging originator opt-in data and consent will not be sold or shared with third parties for their marketing or promotional purposes. We may share mobile information, opt-in records, and consent records with SMS vendors, carriers, aggregators, and other service providers solely as needed to deliver, secure, administer, audit, or comply with legal requirements for the SMS program.
Retention
We retain personal information for as long as reasonably necessary to provide the Services, maintain your account, fulfill the purposes described in this Privacy Policy, comply with legal, tax, accounting, payment, and reporting obligations, resolve disputes, enforce agreements, preserve security and operational records, and protect our rights and the rights of others.
Customer-controlled job board data is generally retained according to the customer's settings, instructions, subscription status, and agreements with Niceboard. After account termination or deletion, some information may remain in backups, logs, archives, payment records, support records, legal records, or other systems for a limited period or as required by law. We may retain aggregated or de-identified information without identifying you.
Security
We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, alteration, and disclosure. No system, transmission, or storage method is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your credentials and for using the Services in a secure manner.
International Transfers
Niceboard is based in the United States, and we and our service providers may process and store information in the United States and other countries. These countries may have privacy laws that differ from the laws where you live. Where required, we use appropriate safeguards for international transfers, subject to our customer agreements and applicable law.
Automated Processing
The Services may use automated processing to support search, sorting, filtering, analytics, security, fraud detection, spam prevention, recommendations, or similar operational features. Niceboard does not make hiring decisions for customers, employers, recruiters, or job seekers. Customers and employers are responsible for their own hiring, recruiting, screening, and employment decisions.
Your Choices and Privacy Rights
Depending on where you live and how you interact with the Services, you may have rights to request access to personal information, correction of inaccurate information, deletion of information, portability or a copy of information, restriction or objection to certain processing, withdrawal of consent, opt out of certain sales, sharing, targeted advertising, or profiling, limit certain uses of sensitive personal information, appeal a privacy rights decision, or lodge a complaint with a regulator.
To make a privacy request, contact us at [email protected]. We may need to verify your identity and authority before responding. If your request concerns information controlled by one of our customers, we may direct you to that customer or work with that customer to respond. Certain information may be exempt from requests under applicable law, such as information we need to provide the Services, maintain security, complete transactions, comply with law, preserve records, or establish, exercise, or defend legal claims.
You may also update certain account information directly in your account. You may opt out of marketing emails by using the unsubscribe link in those emails or by contacting us. You may opt out of SMS messages by replying STOP.
